Arbitration is an alternative to trial by judge or jury. The parties to an arbitration hire a neutral third person (arbitrator) or a group of arbitrators to decide the outcome of their dispute.
- Who makes the decision as to the outcome in an arbitration?
The arbitrator makes the decision as to the outcome based upon testimony and exhibits presented at an arbitration hearing.
- Are the arbitrations binding upon the parties?
Arbitrations can be either binding or non-binding. Binding arbitration decisions are enforceable by the court system and can result in judgments being entered against non-prevailing parties. Non-binding arbitrations are not enforceable as judgments unless the parties agree, after the arbitrator's decision, to be bound.
- Who pays the expenses of arbitration?
The parties agree, usually in writing, as to how the arbitrator's fees and the costs of arbitration will be paid. The parties may divide the costs and fees equally, or they may agree that the party who does not prevail will pay for all costs and fees associated with arbitration.
- Who serves as arbitrator?
Arbitrators may be any person whom the parties agree to have resolve their dispute. Typically, they are attorneys, judges, or laypersons with special experience in the subject matter of the dispute.
- What are Mr. Plumblee's qualifications as arbitrator?
Mr. Plumblee has been trying civil lawsuits for seventeen (17) years in the state and federal courts of South Carolina. He has represented both Plaintiffs and Defendants in all manner of civil trial, including personal injury, products liability, employment disputes, business and contract disputes, and construction disputes. He also has arbitrated most types of civil cases, including personal injury, employment, business and contract disputes, and construction disputes.
