South Carolina has a rule that every civil case is required to go through alternative dispute resolution before it goes to court. In the last few years our firm has been expanding and working with these types of cases.

Alternative Dispute resolution is a means for a dispute to resolve itself through some other way besides court. One way to do this is with Mediation. In mediation you sent with a neutral third party and discuss that issue between all the parties that are part of the matter. The mediator will work with the parties to try and resolve the issue. They will not make a final determination. If an agreement cannot be reached the case may move forward to the court system.

Another way to work through a case without court is Arbitration. Arbitration is also a process where the parties sit down together and work through the case. However, in arbitration the process could be binding and be upheld in court. The arbitrator will listen to both sides and make recommendation regarding the outcome of the case.

Our firm has experienced arbitrators and mediators that can be hired to meet the requirement of the ADR process. In addition, if you would like an attorney to help you with this process we can work with you in the mediation or arbitration process as your lawyer.

Alternative Dispute Resolution is a process that is being used to alleviate some of the pressure from the court system. It is also used to allow parties an alternative to resolving their case.
