Arbitration, Mediation & ADR: Alternative Dispute Resolution is required in all civil trials in South Carolina. ADR is the art of coming to an agreement without going to court. It is used as a cost effective and time saving measure to alleviate some of the pressure in the court system. This does not mean that the outcome is any less than that of a court. Included in the ADR process is mediation and arbitration. Mediation is the process of working through the issue as a group with a neutral third party. Arbitration is also the process of working through the issues. However, the arbitrator acts in a more judicial manner. The results of arbitration can be either binding or non-binding. We both have experience in these areas. |
